LEAD QUALITY DISCLAIMER AND TERMS OF DATA PURCHASE

This Lead Quality Disclaimer (“Disclaimer”) is issued by East Texas Property Pulse, a sole proprietorship owned and operated by Aaron Baugh, located at 20003 Shady Dr., Chandler, TX 75758 (“Provider”), and applies to all lead lists, data, and marketing information provided to the customer (“Buyer”).

1. NATURE OF SERVICES

East Texas Property Pulse is a digital marketing and lead generation firm. We specialize in sourcing real estate leads and data-driven insights for real estate investors, house flippers, and contractors. The leads provided are generated through proprietary methods and third-party data aggregation.

2. "AS-IS" PROVISION

All leads, data, and contact information are provided on an "AS-IS" and "AS-AVAILABLE" basis. While Provider utilizes diligent efforts to source high-quality information, Provider makes no representations or warranties, express or implied, regarding the accuracy, completeness, timeliness, or suitability of the data provided.

3. NO GUARANTEE OF RESULTS; NO ROI REPRESENTATIONS

Buyer acknowledges and agrees to the following:

  • No Conversion Guarantee: Provider does not guarantee that any lead provided will result in a successful contact, appointment, contract, or real estate transaction, or any particular conversion rate.

  • No Accuracy Guarantee: Provider does not guarantee that any lead or data point is accurate, complete, current, or fit for Buyer’s intended use, and Provider does not guarantee deliverability or successful contact.

  • No ROI Guarantee: Provider does not make, and expressly disclaims, any guarantees or representations regarding revenue, profit, return on investment (ROI), deal volume, or other business outcomes.

  • Data Decay: Real estate data is subject to rapid change. Provider does not warrant that property ownership, contact information (including phone numbers and email addresses), or property status remains current at the time of delivery.

  • Exclusivity: Unless otherwise agreed upon in writing via a separate agreement, leads may not be exclusive to the Buyer.

  • Buyer’s Use and Business Outcomes: While Provider strives to deliver high-quality leads, Buyer’s results depend on factors outside Provider’s control (including Buyer’s offer, follow-up practices, market conditions, and compliance practices). Provider is not responsible for Buyer’s business outcomes based on the leads provided.

4. TCPA AND REGULATORY COMPLIANCE

Buyer assumes all responsibility for compliance with local, state, and federal laws regarding the use of the leads provided. This includes, but is not limited to:

  • Telephone Consumer Protection Act (TCPA): Buyer is solely responsible for scrubbing lead lists against the National Do Not Call (DNC) Registry and ensuring compliance with all telemarketing and automated dialing regulations.

  • Texas Data Privacy and Security Act (TDPSA): Buyer must handle all provided data in accordance with applicable Texas privacy laws.

  • Indemnification: Buyer agrees to indemnify and hold East Texas Property Pulse and Aaron Baugh harmless from any claims, fines, or legal actions resulting from Buyer’s failure to comply with marketing and privacy regulations.

5. LIMITATION OF LIABILITY

In no event shall East Texas Property Pulse or Aaron Baugh be liable for any indirect, incidental, special, or consequential damages arising out of the use of, or inability to use, the leads provided. Provider’s total liability for any claim arising from the delivery of data shall not exceed the amount actually paid by Buyer for the specific lead list in question.

6. REFUND POLICY

Due to the digital nature of lead data, all sales are final. Provider does not offer refunds or replacements for leads that do not convert, leads with disconnected phone numbers, or leads that Buyer deems to be low quality, unless specifically agreed upon in a separate written Data Purchase Agreement.

7. ACCEPTANCE OF TERMS

By purchasing, downloading, or utilizing any lead data provided by East Texas Property Pulse, Buyer signifies their understanding and acceptance of this Disclaimer.
