East Texas Property Pulse ("Company," "we," "us," or "our") respects your privacy and is committed to protecting the personal data we collect. This Privacy Policy describes our practices regarding the collection, use, and disclosure of information through our digital marketing and lead generation services, including our services for sourcing, compiling, and delivering real estate lead lists to real estate buyers.
This Privacy Policy is intended to address our obligations under applicable privacy laws, including the Texas Data Privacy and Security Act ("TDPSA"), to the extent it applies to our business and processing activities.
1. Information We Collect
We collect information that identifies, relates to, describes, is reasonably capable of being associated with, or could reasonably be linked to an identified or identifiable individual ("Personal Data"). The types of information we may collect include:
Contact Information: Name, mailing address, email address, and phone number(s).
Property and Public Record Information: Property address, parcel/lot information, ownership status, county appraisal/tax information, deed or other recorded instrument references, and other real estate-related information sourced from public records.
Commercial and Professional Information: Records of real estate interests, lead list criteria or preferences, and information relating to our business-to-business relationship with customers.
Payment and Billing Information: Billing address and partial payment card details (such as the last four digits) as processed by our third-party payment processors. Full credit card details are handled exclusively by our payment processors and are not stored on our servers.
Internet/Device and Usage Information (where applicable): IP address, browser type, device identifiers, pages viewed, approximate location derived from IP address, and similar analytics data.
Communications: The contents of communications you send to us (for example, emails, form submissions, or messages).
We do not intentionally collect Sensitive Data (as that term is used in the TDPSA) except where necessary and permitted by law. If we ever process Sensitive Data, we will do so in accordance with applicable law, including any required consent.
2. How We Collect Information
We source information through several methods:
Public Records: Information obtained from county clerk records, appraisal districts, tax assessors/collectors, and other government databases and publicly available sources.
Direct Submission: Information provided to us by individuals, customers, or partners (for example, when you contact us, submit a form, or respond to outreach).
Data Sourcing Tools: Internal and third-party tools used to locate, collect, and aggregate publicly available information for lead generation purposes.
Automated Collection (where applicable): Cookies and similar technologies used on our websites or landing pages to support functionality and analytics (if and when used).
3. How We Use Information (Lead Generation and Business Purposes)
East Texas Property Pulse uses Personal Data for purposes that may include:
Lead Generation and List Curation: Identifying potential real estate opportunities and creating and curating lead lists.
Providing Services to Customers: Delivering lead lists and related information to real estate buyers (including investors and house flippers) who purchase access to such leads.
Communications: Communicating with individuals and customers regarding our services, potential real estate-related opportunities, and administrative messages (including support and notices).
Operations and Improvements: Maintaining, operating, and improving our data sourcing methods, internal systems, quality control, and recordkeeping.
Security and Fraud Prevention: Protecting our systems, preventing misuse, and detecting security incidents.
Legal and Compliance: Complying with applicable law and enforcing our agreements, including compliance efforts relating to the TDPSA.
4. Disclosure, Sale, and Sharing of Personal Data
We are a digital marketing and lead generation firm; therefore, the sharing and transfer of lead information—including transfers that may be considered a "sale" under certain privacy laws—may be a primary function of our business.
We may disclose or share Personal Data with the following categories of recipients:
Real Estate Buyers (Our Customers): Investors, house flippers, and other real estate buyers who purchase lead lists to pursue property acquisitions or related outreach. These customers may use the information to contact individuals about potential property transactions.
Service Providers and Vendors: Third-party providers who support our operations (such as data hosting, analytics, CRM tools, IT support, or professional services) and who are authorized to process Personal Data on our behalf subject to appropriate contractual restrictions.
Legal, Safety, and Business Transfers: When required by law, subpoena, court order, or governmental request; to protect rights, safety, and security; to investigate suspected fraud or misuse; or in connection with a merger, acquisition, financing, due diligence, reorganization, or sale of assets.
Important note about customers’ use: When Personal Data is transferred to real estate buyers, those buyers may act as separate controllers or businesses with their own privacy and compliance obligations. We do not control how a customer uses Personal Data once delivered, and their practices may differ from ours.
5. Texas Data Privacy and Security Act (TDPSA) Disclosures and Texas Resident Rights
Where the TDPSA applies, and subject to applicable exceptions, Texas residents may have the following rights regarding their Personal Data:
Right to Access/Confirm: The right to confirm whether we are processing your Personal Data and to access such data.
Right to Correct: The right to correct inaccuracies in your Personal Data, taking into account the nature of the data and purposes of processing.
Right to Delete: The right to request deletion of Personal Data provided by you or obtained about you, subject to legal exceptions.
Right to Data Portability: The right to obtain a copy of your Personal Data in a portable and, to the extent technically feasible, readily usable format where processing is carried out by automated means.
Right to Opt-Out: The right to opt-out of the processing of Personal Data for purposes of (i) targeted advertising, (ii) the sale of Personal Data, or (iii) profiling in furtherance of decisions that produce legal or similarly significant effects.
How to Submit a TDPSA Request
To exercise your rights, submit a request using the contact details in Section 9. We may need to verify your identity before we can fulfill certain requests. If you submit a request through an authorized agent, we may require proof of the agent’s authority and may still need to verify your identity.
Appeals (TDPSA)
If we deny your request, you may appeal our decision by responding to our denial notice or contacting us using the information in Section 9 with the subject line "TDPSA Appeal." If your appeal is denied, you may have the right to contact the Texas Attorney General.
6. Telephone Consumer Protection Act (TCPA) Compliance
We strive to handle lead data in a manner intended to support compliance with applicable marketing and outreach laws, including the Telephone Consumer Protection Act (TCPA), as applicable. We do not guarantee that third-party buyers will maintain TCPA compliance once data is transferred, and buyers are encouraged to perform their own "Do Not Call" (DNC) registry scrubs and to obtain any required consents before contacting individuals.
7. Data Security
We implement reasonable administrative, technical, and physical security measures designed to protect the Personal Data we maintain from unauthorized access, acquisition, disclosure, alteration, or destruction. However, no method of transmission or storage is 100% secure, and we cannot guarantee absolute security.
8. Data Retention
We retain Personal Data for as long as reasonably necessary to fulfill the purposes for which it was collected, including to provide services, maintain records, resolve disputes, enforce agreements, and satisfy legal, accounting, or reporting requirements. Retention periods may vary depending on the nature of the data and the context in which it was collected.
