These Website Terms and Conditions (“Terms”) govern your use of the website and services provided by East Texas Property Pulse, a sole proprietorship owned and operated by Aaron Baugh (“Company,” “we,” “us,” or “our”). By accessing our website or using or purchasing our digital marketing and lead generation services, you agree to be bound by these Terms. The Company’s mailing address is 20003 Shady Dr., Chandler, TX 75758.

1. SERVICES PROVIDED

East Texas Property Pulse is a digital marketing and lead generation platform. We specialize in sourcing and providing real estate lead lists for real estate investors, house flippers, and contractors (“Services”). Our Services involve the collection of data and delivery of actionable lead opportunities to our clients (“Buyers”).

2. ELIGIBILITY

By using this website, you represent and warrant that you are at least 18 years of age and possess the legal authority to enter into a binding agreement. You agree to use the Services only for lawful purposes and in accordance with these Terms.

2A. USER OBLIGATIONS

You agree to:

  • Provide accurate and complete information when submitting forms, requesting information, or purchasing Services.

  • Maintain the confidentiality of any login credentials (if applicable) and restrict access to your account and devices.

  • Use the Services and any purchased data only for legitimate business purposes and in compliance with these Terms and all applicable laws and regulations.

  • Ensure that your marketing, outreach, and communications practices (including calls, texts, emails, direct mail, and advertisements) are compliant with applicable laws (including those referenced in Section 5).

  • Promptly notify us of any unauthorized use of your account (if applicable) or suspected security incident relating to your use of the website or Services.

3. PURCHASE AND PAYMENT

All lead lists and data packages are sold for a flat fee as specified at the time of purchase. All sales are final. Due to the digital nature of the product, no refunds shall be issued once the data has been delivered.

3A. SUBSCRIPTION SERVICES

We may offer certain Services on a subscription basis (“Subscription Services”). Subscription tiers may include:

  • Starter: $149/month

  • Pro: $399/month

  • Titan: $899/month

3B. BILLING AND CANCELLATION

Subscription Services are billed monthly on a recurring basis until canceled. To avoid being charged for the next billing cycle, you must cancel your subscription at least 48 hours before your next billing date. All sales are final, and we do not offer pro-rated refunds for mid-month cancellations.

4. INTELLECTUAL PROPERTY

The website, including its original content, features, functionality, and the proprietary lead lists generated by East Texas Property Pulse, are and will remain the exclusive property of Aaron Baugh (and/or the Company’s licensors, where applicable). You are granted a limited, non-exclusive, non-transferable, revocable license to use the purchased data for your own internal business purposes. You may not resell, redistribute, reproduce, publish, display, modify, create derivative works from, reverse engineer, or sublicense our lead lists or any portion of the website content to third parties without express written consent. All rights not expressly granted are reserved.

5. COMPLIANCE WITH LAWS (TCPA & TDPSA)

As a condition of using our Services, Buyers agree to comply with all applicable local, state, and federal laws, including but not limited to:

  • Telephone Consumer Protection Act (TCPA): Buyers are solely responsible for ensuring that any outreach (calls, texts, or faxes) made to leads provided by the Company complies with TCPA regulations, including checking the National Do Not Call Registry.

  • Texas Data Privacy and Security Act (TDPSA): Both parties shall handle personal data in accordance with the TDPSA.

  • CAN-SPAM Act: Buyers must comply with all regulations regarding electronic mail marketing.

6. DISCLAIMER OF WARRANTIES

The Services and data are provided on an "AS IS" and "AS AVAILABLE" basis. East Texas Property Pulse makes no representations or warranties of any kind, express or implied, regarding the accuracy, completeness, or reliability of the leads provided.

  • We do not guarantee that leads will result in a successful transaction, contract, or profit.

  • We do not warrant that phone numbers or contact information provided are 100% accurate or currently active.

  • All marketing risks are assumed by the Buyer.

6A. PROHIBITED ACTIVITIES

You agree not to, and not to permit any third party to:

  • Use the website or Services for any unlawful purpose or in violation of any applicable law or regulation.

  • Engage in harassment, threats, intimidation, or any deceptive, misleading, or unfair marketing practice.

  • Send spam, unsolicited bulk messages, or otherwise violate CAN-SPAM, TCPA, state telemarketing laws, or similar rules.

  • Misrepresent your identity, impersonate any person or entity, or falsely imply affiliation with the Company.

  • Copy, scrape, harvest, crawl, or use any automated means to access, extract, or collect data or content from the website (except as expressly authorized in writing by the Company).

  • Attempt to probe, scan, test, or breach the security of the website; introduce viruses, malware, or other harmful code; or interfere with the website’s operation.

  • Resell, redistribute, or publish the lead lists or data, or use the Services to build or enhance a competing database or product, unless expressly authorized in writing by the Company.

  • Use the website or Services in a way that infringes or misappropriates the Company’s intellectual property or the rights of others.

7. LIMITATION OF LIABILITY

In no event shall East Texas Property Pulse, Aaron Baugh, or its employees be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, or business opportunities, arising out of or in connection with your use of the Services. Our total liability for any claim arising out of these Terms shall not exceed the amount paid by you for the specific lead list in question.

8. INDEMNIFICATION

You agree to defend, indemnify, and hold harmless East Texas Property Pulse and Aaron Baugh from and against any and all claims, damages, obligations, losses, liabilities, costs, or debt, and expenses (including but not limited to attorney's fees) resulting from: (i) your use and access of the Services; (ii) your violation of any term of these Terms; or (iii) your violation of any third-party right, including TCPA or privacy claims.

9. GOVERNING LAW

These Terms shall be governed and construed in accordance with the laws of the State of Texas, without regard to its conflict of law provisions. Any legal action or proceeding related to these Terms shall be brought exclusively in the courts located in Henderson County, Texas.

10. CHANGES TO TERMS

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. By continuing to access or use our Services after those revisions become effective, you agree to be bound by the revised terms.
